These general contracting conditions will expressly regulate the commercial relations between ASOCIACIÓN JUNIOR EMPRESA RISEWAY (hereinafter, AMBROSIA DELICAT) and the users who purchase the products offered through this website.
Users are informed that AMBROSIA DELICAT reserves the right to modify these general contracting conditions at any time, in any case, respecting in all cases the general conditions in force at the time of the contracting or purchase made by the user. .
These conditions have been prepared in accordance with the provisions of Law 34/2002, on services of the information society and electronic commerce, Law 7/1998 on General Conditions of Contract, Royal Legislative Decree 1/2007 by which approves the revised text of the General Law for the Defense of Consumers and Users in its latest amendment contained in Law 3/2014 of March 27, Law 7/1996 on the Regulation of Retail Trade and any legal provisions resulting of application.
The user, with the acceptance of the terms and conditions, declares to know and accept the procedures exposed here as necessary to proceed with the purchase.
PRE-PURCHASE INFORMATION
All users will be able to view all the products offered for purchase on the website, classified by category. By clicking on each of them, the user will be able to access a complete file of the product where a brief description, its availability and price will be indicated. Users are informed that all the data provided in the description of the products is made based on the information provided by their suppliers.
All prices are shown in euros and do not include applicable VAT and/or any other applicable taxes. Said prices will be the current ones at all times, except for possible manifest typographical errors. Transport is not included in the prices shown for the products, although the cost will be free beyond a purchase of €70, the cost being broken down later at the time of completion of the purchase.
The user is informed that the product purchased through this website may suffer, due to availability of the manufacturer, non-substantial modifications in the components, characteristics or benefits of the batch that integrate it, as long as they do not imply a demerit of the qualities and advertised benefits.
PURCHASE SYSTEM
The procedures to carry out the acquisition of products will be those shown on the screen at all times and described in these General Conditions. Users may subscribe as members of the AMBROSIA DELICAT newsletter during the product purchase process to enjoy promotional benefits.
To proceed with the acquisition of the products, the user must click "Buy" on each product. As the user selects what they want, they can preview in the upper right part of the website the "Cart" or "Basket" with the products pending payment, which will be updated as products or services are added, as well as the costs of transportation. If the user wants to see their order in more detail, they can click on "Cart" and they will be directed to another screen where they can see a summary of the selected products. From there you will be able to choose between continuing shopping or confirming your order.
On the "Cart" or "Basket" Summary screen, the user may make use of a discount voucher that AMBROSIA DELICAT has given him as a result of a promotion, raffle or other circumstance. To validate it, you must click on "Apply Coupon" and you will see the discount in the price breakdown, as long as it is still valid according to your particular conditions.
When the user has finished his shopping list, he must click on the "Finish Purchase" button that he will find at the bottom of the breakdown of his purchase. From this moment you must complete the information as requested and select, if applicable, the delivery and billing address, shipping method, as well as indicate the payment method you wish to use.
PAYMENT SYSTEM
Payment can be made via bank transfer, credit or debit card, Apple Pay or PayPal. The user will be able to choose the payment method at the end of the purchase, and both payments will be subject to the following conditions:
Payment by credit card will be made through a payment gateway managed by a bank with a secure server certified according to the SSL protocol. The bank details entered are encrypted and securely transmitted to the services of the bank and are subsequently verified with the issuing bank to prevent possible fraud and abuse. AMBROSIA DELICAT does not have bank details or the credit or debit card used by the user to make the purchase.
When the amount of the purchase has been charged fraudulently or improperly using the payment card number, it will give the buyer the right to demand the immediate cancellation of the charge. However, if the purchase had actually been made by the cardholder buyer and the return requirement was not a consequence of having exercised the right of withdrawal or resolution, the buyer will be obliged to compensate the damages caused by the merchant. consequence of said cancellation.

ORDER SHIPPING

AMBROSIA DELICAT ships mainly throughout the Spanish territory, including the Balearic Islands, Canary Islands, Ceuta and Melilla and also internationally, although orders are also made worldwide.

Users are informed that on Saturdays, Sundays and holidays there will be no delivery service. Therefore, these days count as non-business days.
EXCEPTIONS IN DELIVERY TIMES
During special offers on the AMBROSIA DELICAT website, the delivery time may be longer than usual.
AMBROSIA DELICAT will not assume any responsibility for delay in the delivery of orders when this delay is the exclusive fault of the buyer or the authorized person.
The client assumes the risks of deterioration, impairment, damage and loss of the products of the order from the moment of delivery of the same in accordance with the procedure regulated in these Terms and Conditions. The client will be responsible for the storage and conservation of the products under the conditions that, where appropriate, are established on their labeling.
If an item is not in stock at the time you order, we will let you know and give you the ability to reserve that item immediately so you can get it when it becomes available.
SEND CONDITIONS
The customer will be responsible for verifying the content and condition of the merchandise at the time of delivery. Once your signature has been accepted and entered on the copy of the delivery note to be returned to the carrier, you will have expressed your agreement with what was received and waived any subsequent claims about the suitability and identity of the merchandise requested and received. In the event that the customer verifies errors in the merchandise received or that it is visually damaged at the time of delivery, he must record these circumstances on the carrier's delivery note and must inform us of these facts within 24 hours.
TAXES AND OTHER CHARGES
In the case of import fees and/or customs procedures, these expenses will be borne by the buyer.
WITHDRAWAL POLICY
The customer will have a period of up to fourteen (14) calendar days from receipt of the product to exercise their right of withdrawal, without indicating any reason.
This right of withdrawal will not be contemplated for products that need a cold chain or in the case of products with an imminent expiration date or a high probability of suffering deterioration in a short period of time.
To exercise the right of withdrawal, you must notify us of your decision to withdraw from the contract through an unequivocal statement to the email address info@ambrosiadelicat.com. To comply with the withdrawal period, it is sufficient that the communication regarding the exercise by you of the right of withdrawal is sent before the withdrawal period expires.
In the same way, the user is informed that, based on the provisions of article 103.c) of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, you will not be able to exercise your right of withdrawal on those goods made according to your specifications or that are clearly personalized.
In case of withdrawal on your part, all payments received from you will be returned to the client in the same form of payment in which it was made. The shipping costs to make the return will be borne by the user. The returned products must be in normal conditions (with their original packaging and without using or handling). It will be necessary to attach a copy of the invoice. Before returning the Product, the Customer must ensure that it is properly protected and sealed so that it does not suffer any damage during transport.
If the cause of the return is that the product is defective or does not correspond to what was ordered, AMBROSIA DELICAT will bear the costs of the return and the new shipment. If the reason is that the order does not satisfy you, we will refund the amount, but not the return costs. Additional delivery costs will not be paid if the user has expressly selected a delivery method other than the least expensive ordinary delivery method.
The refund of the amount will be made once the returned order arrives at our offices and with the same payment method that has been used: either it will be paid to your credit card or to your PayPal account. For orders by cash on delivery, a bank transfer will be made to the indicated account.

APPLICABLE LEGISLATION. SUBMISSION TO JURISDICTION
The use of our website and the contracts for the purchase of products through said website will be governed by Spanish law.
Any controversy that arises or is related to the use of the website or with said contracts will be submitted to the non-exclusive jurisdiction of the Spanish courts and tribunals.
If you are contracting as a consumer, nothing in this clause will affect the rights that current legislation recognizes as such.
